Robbery case involved Ebrima Sonah and Malick Ndong has been transferred from the Kanifing Magistrate Court to High Court as the charges pressed against the two accused person is capital offence.
On Thursday when the duo accused persons Ebrima Sonah and Malick Ndong who had jointly robbed with violence appeared before the Kanifing Magistrate Court presided over by Magistrate Mama Samba Jallow, among the three prosecutors in charge of the case namely: Superintendent Manga, CIP Touray and Sergeant 3577 Kebbeh, Superintendent Manga apply for the transfer of the case to special criminal division of the High Court of The Gambia which captured in the directive of legal notice number 3 of 2009 to deal with capital offences.
“The charge which the accuse persons are charge of is a capital offence on that note we are appealing this matter to be transfered to the special criminal division of the High Court while the accused persons should be remanded at Mile 2 prison pending the hearing of the matter at the special division of the High Court pursuance to section 62 and 208A of the criminal code cap 10 vol iii laws of the Gambia,” he said”.
The court grants the application of the prosecution and ordered the transfer of the case to the Special Division of the High Court and remand the accused persons pending the hearing of this matter in the High Court of The Gambia.
Meanwhile, Ebrima Sonah and Malick Ndong on or about the 15th day of June 2021 at Fajara the two accused persons jointly robbed Ali Shuma , Fatimah Kassir and Abubacarr Camara with violence by tying and assaulting them while armed with two cutlasses , one wooden baton, tear gas and crew bar (metal iron )and forcefully took the following items – Cash amount to D11,000.00, two sets of gold chain valued at D20,000.00 One mobile phone marked Samsung A21 valued D5000.00.The total sum of 36,000 (thirty- six thousand dalasis), being the properties of Ali Shuma and Fatimah Kassir.
