The on-going civil claims case between Alhagie Samba Bah (plaintiff) and Ebrima Mboow (Defendant) is expected to resume at the Brusubi Magistrate Court presiding over by Principal Magistrate Krubally on the 7th July 2021
The plaintiff Alhagie Samba Bah is claiming the sum of D665, 000.00 (six hundred and sixty five thousand dalasi) from the (Defendant) Ebrima Mboow who was detained at Kairaba Police station in connection to a car that he sold at value of D665,000.00.
The plaintiff Alhagie Samba Bah claimed that he used his money amounting to the said D665, 000.00 to help the defendant Ebrima Mboow to be released on bail. However, since then the defendant failed to settle the money despite several requests, which has landed them to court.
In other appearance before the next date, presiding over the Exparte Motion dated on the 24th Day of May 2021, the Principal Magistrate Krubally said: Having heard the Applicant herein Mr Alhagie Samba Bah moved his motion with genuine prayers support by 15 paragraphs affidavit containing relevant facts therein , I am satisfied, pursuant to the prayers contained in his motion considered with all the facts and circumstances in his affidavit in support, shall incline me to immediately grant the said prayers therein, based on that, the honourable court ordered the (defendant) Ebrima Mboow be immediately arrested by the Bailiff/Sheriff police officer.
The further ordered that the said defendant Ebrima Mboow shall place or provide good, valid and sufficient security to the custodial egis court equivalent to the Applicant claim of (D665,000.00) dalasi with immediate effect and also the court ordered that if the said defendant herein Ebrima Mboow fails to comply with the same, he shall be remanded and shall not be released there from until he comply with the order.
This was the car the defendant guarantee to the plaintiff but later took the car with a promise that he will sell it and settle the money which he woefully failed.
