Carla Morris, an American-African descendant, has sued Darboe Jula Real Estate Agency and its Chief Executive Officer Lamin Darboe for a breach of agreement over plots of land at the High Court in Banjul.
Carla and the housing company entered into an agreement over a property in Sanyang measuring 125 x 126 x 84 x 155 meters for 1.6 million dalasis
Ms Morris wants the court to make declaration that the Real Estate Company and its CEO Lamin Darboe have no right to rescind the contract they signed dated 9th July 2021, and wants the court to make an order compelling the company and CEO Darboe to accept the remainder of the money for the land and for the company to issue her the official transfer of ownership of the land.
She also asked the court to make an order for the company and CEO Darboe to pay her damages for the breach of the contract they signed.
Ms Morris also asked the court to make perpetual injunction orders to restrain the company and its CEO, its employees and whosoever from trespassing on the land.
She wants 35% as interest from January 2021 being the date the company refused to collect from after. Also, she wants D 250,000 as legal and administrative cost.
However, Darboe Jula Real Estate Agency and its Chief Executive Officer Lamin Darboe have pleaded with Carla Morris to grant time to allocate her another land after an alleged breach of their contract.
Meanwhile, Lawyer B. Secka told the High Court that his clients, Darboe Jula Estate Agency and Lamin Darboe do not want to continue with litigation of the case as they opt for an out of court settlement.
Lawyer Secka asked the court to grant them time to go with Mrs Morris for a site visit at their estates to select the land of her choice.
“Is that your position, Mr Baldeh?” asked Justice Bakre. Lawyer Y. Baldeh for Mrs Morris told the court that he has no objection to the offer.
The court adjourned the case to 24 of March 2022 at 10 am for settlement.
