Magistrate Isatou Dabo of the Brikama Magistrates’ Court presided over the case of one Pa Modou Faye, a resident of Farato village, West Coast Region who was on Monday appeared at the court, charged with one count of offence attempt to commit felony contrary to Section 365 of the Criminal Code Cap 10:01 Volume 111 Revised Laws of The Gambia 2009.
The particulars of his offence read that Pa Modou Faye, did on or about the 3rd of April 2022 at Farato Village, Kombo North West Coast Region in the Republic of The Gambia was unlawfully roaming within the shop premises of one Karamba Kanyi with intent to commit felony, thereby committed an offense.
The accused pleaded not guilty to this count.
Karamba Kanyi, the shopkeeper told the court that, he was sleeping at his house but was informed of the damage to his shop on the 2nd April 2022.
He said “upon receiving this information, I went to verify what happened at my shop and I took pictures of the damage done to the shop but on the 4th April 2022, I received a telephone call from Farato Police station and I was informed of the second break into my shop.
When I arrived at my shop, I opened the doors and realized that the roof of the shop was destroyed, but I did not hesitate to report the damage at the Farato Police station because I was asked at the Police station if I will be able to identify a suspect,” he added.
He further told the Court that it was one Omar Suwareh and Dwada Samba who informed him that Pa Modaou Faye was the suspect because he was seen standing beside the main Mosque of Farato Village wearing a blue jumper at 4:00 am on the 3rd April 2022. He added that he confirmed this when he met the accused, Faye, beside Farato the main Mosque with the same color of the jumper.
“I told the accused to follow me to the Police station because I suspected him of destroying my shop and we both went to Farato Police station,” he added. The case was adjourned to the 18th of August 2022 at 11:00 am.
