The Brikama Magistrates’ Court presided over by Magistrate Ebou Sowe has convicted Pateh Baldeh, Samba Baldeh, Alasana Jamanka, Demba Kandeh, Ebrima Jamanka, and Juldeh Baldeh, all natives of Niggie Village, West Coast Region for trespass and assault of Muhammed Baldeh also a native of Niggie village.
They were fined to pay D3000 each while the 5th accused, Juldeh Baldeh was separately fined to pay D7000 compensation to Edrissa Baldeh for causing him bodily harm.
According to the narration by the prosecution officer Inspector Kemo Y Manneh, the accused namely Pateh Baldeh, Samba Baldeh, Alasana Jamanka, Demba Kandeh, Ebrima Jamanka, and Juldeh Baldeh on the 14th June 2022 between the hour of 11:00 to 11:30 unlawfully entered the house of Muhammad Baldeh and broke his corrugated door, a plastic round pan, and a wooden fence.
He said the 5th accused, Juldeh Baldeh, assaulted Edrissa Baldeh with a stick and inflicted serious injuries on his body during the crime.
Prosecutor Manneh added that the accused, Pateh Baldeh, Samba Baldeh, Alasana Jamanka, Demba Kandeh, Ebrima Jamanka, and Juldeh Baldeh were arrested on the 14th of June 2022 and taken to Madinaba Police Station where they were cautioned and charged accordingly for trial.
He noted that the victim, Edrissa Baldeh was escorted by Inspector Ebrima Sanyang to Brikama Hospital where he was treated and discharged.
He went on to tender the photos of the damaged properties of the plaintiff, Muhammad Baldeh, to the court and the medical Certificate of the victim, Edrissa Baldeh which was admitted and marked as exhibits. Magistrate Ebou Sowe accepted the plea of prosecutor K. Y. Manneh and admitted the broken wooden fence as Exhibit A, the corrugated door as exhibit B, the plastic round pan as exhibit C and the victim’s medical Certificate as exhibit D.
“I plead to this honorable court to give an order to the natives of Niggie Village to maintain peace and order and the 5th convict, Juldeh Baldeh to compensate Edrissa Baldeh for causing him serious bodily harm “, Inspector Kemo Y. Manneh pleaded to the Court.
However, Magistrate EbouSowe stated that the accused, Pateh Baldeh, Samba Baldeh, Alasana Jamanka, Demba Kandeh, Juldeh Baldeh, and Ebrima Jamanka did not waste the time of the court and as first-time offenders, he did not impose a sentence against them instead he fined them each to pay D3000 and in default to spend one-year imprisonment. However, he ruled that the 5th accused, Juldeh Baldeh should pay compensation of D7000 to Edrissa Baldeh for causing the plaintiff serious injuries on his body, and in default to spend two years imprisonment.
