Defense cross-examines PW2 in Alleged Murder Trial

Defense Counsel, Moses Richard on Wednesday cross-examined the second prosecution witness, Salam Barry in an alleged murder trial involving one Modou Lamin Njie before Justice Isatou Janneh of the Kanifing high court.

The witness, Salam Barry, a brother to the late Ismaila Barry in cross-examination said the incident took place around 5pm to Magrib time when he was at home and heard his brother warn the accused ModouLaminNjie not to sell alcohol to their elder brother.

“Yes the accused person  told my younger brother Ismaila that if you do not avoid me I will kill you, always when the accused meets my younger brother he usually say to him if you are not careful I will kill you” he stated

Witness further told the court that his elder brother usually drinks alcohol and smokes and he wanted their elder brother to be a better person that is why he always advised the accused ModouLaminNjie not to sell alcohol to their brother.

He continued: “I was outside the tailoring shop and saw my brother Ismaila running inside the compound as the accused wanted to hit him with a stick having a nail.  I witnessed when the accused was beating my brother with a stick having nails, while the accused ran away I decided to aid my brother than pursuing the accused.”

The witness further testified that what happened at the initial place where the fight started was narrated to him by the boys and that when his brother came outside he did not come with a knife and that he did not see his younger brother Ismaila with a knife.

According to the particulars of offense Modou Lamin Njie on or about the 22nd day of July 2022 in Kanifing, Layout, allegedly with malice aforethought unlawfully caused the death of Ismaila Barry by hitting him with a wooden stick on the head.

The case was adjourned to 30th of March 2023m, at 10am and 3rd of April for prosecution witness three to testify.
