Prosecution witness Basiru Y Darboe on Wednesday at the Kanifing High Court presided over by Justice IsatouJanneh testified in the alleged robbery case involving Alagie Corr and Mamadou Salieu Jallow.
The witness in his testimony said it was 21st September 2022 around the hours of 11:55 pm, when he was at the office Abdou Sowe together with Sheriff Jallow and one person he cannot recall the name arrived with the complainant, Momodou Salieu Jallow, and the accused, Alagie Corr.
He narrated that the complainant complained that he was attacked by Alagie Corr with a broken bottle, that was when I conducted a search on Alagie Corr and found a broken bottle at the right side of his pocket and mark it with the exhibit with a diary reference number.
The bottle was presented to the witness and he confirmed it with the reference number.
The State Counsel Alieu A Marong tendered the broken bottle and was not objected to by the defense counsel while Justice Isatou Janneh admitted the green broken bottle as an exhibit.
The witness, Basiru Y Darboe continued his testimony that from the search, the complainant Momodou Salieu Jallow was complaining of body pain and was later escorted to the Kanifing general hospital by one of his colleagues for a medical checkup and upon their arrival from the hospital a case file was opened and forwarded to the CID.
Counsel M. Ceesay sought an adjournment stating that he cannot cross-examine the witness as she was unable to go to Mile II to talk with her client.
State counsel Alieu A Marong said he has no objection to the adjournment but was quick to say that the defense counsel wants to make it customary to seek an adjournment when a witness testifies and considering today’s short testimony she asked for an adjournment and that if a particular case should take them for six months an adjournment like this will make the case to take them for a whole year.
According to the particulars of the offense AlagieCorr on about the 21st of September, 2022 at Westfield in the Kanifing Municipality of the Gambia, attacked and stabbed AlagieCorr Mamadou Salieu Jallow with a broken bottle and forcefully took away his mobile phone mark Pop 4 valued at D7500, a bag containing D2000, sachets of milk and coffee valued at D3000, and two vacuum flasks valued at D2000.
Justice Isatou Janneh, however, said in the vacation in the court’s diary the matter is adjourned to 3rd May at noon, 4th May at 11 am, and 10th May at 11 am for the continuation of hearing.
