Justice Francis A. Achibonga yesterday dismissed the summon of the City Mayor after a thorough review of her counsel summons regarding her denial of the investigation of the Commission of Inquiry on the bases of its impartiality in the execution of their functions.
During the deliberation of the judgment, Justice Achibongapointed out that the allegations raised by counsel Rachael R. Mendy for the applicant (Mayor Malick Lowe) concerning the Attorney General, Samba Faal, Oreme E. Joiner, and AlagieSallah were not proven by the Mayor’s counsel, noting that such applications of her counsel hold no merits.
Justice Achibonga disclosed that the applicant’s exhibit marked RL6 was a self-written document against Oreme E. Joiner and overruled the weight of its evidence filed against Oreme E. Joiner saying that it can be done through the digital system.
Justice Achibonga also said that the applicant’s counsel R Mendy alleged that Samba Faal, Oreme E. Joiner, and AlagieSallah won’t be fair in their mandates as commissioners of the Commission of Inquiry that must look into the transactions of all the Local Government Councils with fairness.
The presiding Justice Achibonga noted that one is free to be affiliated with any political party but such individuals should not allow their political party to hinder them in exacting their functions.
Justice Achibonga at this juncture, overruled the Summon of Mayor Malick Lowe stating that the evidence of her counsel holds no merits and lacks sufficient evidence that is justifiable. ”I hereby dismissed the summon of the applicant ”, Justice Achibonga ruled.
