The Principal Magistrate of Brikama Magistrates’ Court, Anna O. Mendy, last Thursday granted a bailedto a voluntary compliance officer of Brikama Area Council (BAC), Touba Ceesay, in the sum of D100, 000.
It’s alleged that Touba Ceesay on or about December6, 2023, at Brikama Area Council, West Coast Region of the Republic of The Gambia, whilst in a public place, used insulting and abusive language against the Chief Executive Officer of Brikama Area Council, Modou Jonga.
In her ruling on the bail application of Ceesay last Thursday, Magistrate Anna O. Mendy said that prosecution did not advance any reason before the court to suggest denial of bail to Ceesay.
Magistrate Mendy also said that despite the prosecution having told the court that investigations into the incident that occurred between the Chief Executive Officer of BAC and a group of BAC councilors are ongoing there was no evidence before the court that may suggest that the accused, Ceesay might jump bail if granted bail.
She pointed out that there was no previous criminal record that suggested that Ceesay should be denied court bail.
Magistrate Mendy at that juncture granted a bail sum of D100,000 with two Gambian sureties who shall deposit their valid national identity cards or national passports to the court registrar, noting that the sureties of Ceesay shall be sworn to an affidavit of means.
Meanwhile, Ceesay’s statement of offence showed that he stands accused of prohibition of conduct conducive to breaches of peace Conduct contrary to Section 9 of the Public Order Act, Criminal Code Cap 22:01, Volume IV, Laws of The Gambia 2009.
