2 Men Docked For Alleged Stealing

Lamin Bojang and Mustapha Jarju were arraigned before magistrate K.B Sambou of the Brikama Magistrates’ court on Tuesday, for allegedly stealing a bag containing shoes and cash.

Sergeant 3645  F. Trawally represented the Inspector General of Police, while the two accused persons were not represented during the plea taking. 

According to the charge sheet, the duo is accused of stealing contrary to section 252 of the Criminal Procedure Code cap 10:01 volume III Laws of the Gambia 2009.

The particulars of offence explained that Lamin Bojang and Mustapha Jarju allegedly stole a bag containing a pair of boots and three thousand five hundred dalasi being the property of one Hadim Jarjusey, thereby committed offence. 

Both accused persons denied the liability of the charge against them. 

Section 252 of the criminal code of the Gambia said: “Anyone who steals anything capable of being stolen is guilty of the felony termed theft, and is liable, unless owing to the circumstances of the theft, or the nature of the thing stolen, some other punishment is provided, to imprisonment for five years.”

The prosecution sought adjournment to enable them to secure the presence of witnesses in the case. Sergeant Trawally told the court that the prosecution is not objecting to the bail of the accused person because the charge against them is bailable. 

Magistrate K.B. Sambou granted the application made by the prosecution.

The two accused persons are granted bail at a bond of D30,000.00 each with one Gambia surety who shall depose to a sworn affidavit.

The matter is adjourned to the 1 May for hearing.
