Principal Magistrate Anna O. Mendy of the Brikama Magistrates’ Court has remanded two accused persons charged on three counts of violations.
ASP Buteh Sawaneh represented the Inspector General of Police, while the accused persons were not represented by any counsel during the plea taking.
According to the indictment before the court, Ebrima Jammeh and Amadou Bah faced three counts of law violations. These are assault, threatening violence, and criminal trespass.
Count one statement of offence alleged that the two accused persons assaulted, causing actual bodily harm contrary to section 228 of the criminal code of the Gambia.
Its particulars of offence stated that EbrimaJammeh and Amadou Bah unlawfully assaulted one Wurry Bela Kanteh by stabbing with a knife on her back causing her actual bodily harm.
Section 228 of Criminal Procedure Code states that any person who commits an assault occasioning actual bodily harm is guilty of a misdemeanor and is liable to imprisonment for seven years.
On count two, the two accused persons are charged with threatening violence contrary tosection 84 of the Criminal Procedure Code revised edition 2009.
Particulars of offence for count two detailed that the accused persons intentionally threatened to kill one Wurry Bela Kanteh with a knife and cutlass, thereby committed offence.
According to section 84 of CPC, anyone who intimidates or annoys any person, threatens to injure, assault, shoot, or kill any person or to burn, break or injure any property, shall be guilty of an offence and shall be liable on conviction to a period not exceeding three years.
The duo is also charged with criminal trespass contrary to section 285(a) of the Criminal Procedure Code.
Its particulars of offence revealed that EbrimaJammeh and Amadou Bah unlawfully entered into the compound of Wurry Bela Kanteh with intent to intimidate or annoy the said victim, thereby committed an offence.
ASP Buteh Sawaneh opposed to the bail of the accused persons on account that the victim is still hospitalized at the Brikama District Hospital.
He sought adjournment to enable the prosecution to secure its witnesses into the matter.
The court granted the application made by the prosecution and adjourned the matter to 14thMay 2024.
