Ebrima Kalilu Juwara recently appeared before principal magistrate Anna O. Mendy of BrikamaMagistrates’ Court charged with obtaining money by false pretense.
The accused appeared for the fourth time on similar offences of fraudulently obtaining money from victims with a promise of giving them plots of land.
The statement of offence revealed by the indictment forwarded by the prosecution indicated “obtaining money by false pretenses,” contrary to section 288 of the criminal code of the Gambia.
The particulars of offence alleged that Ebrima KaliluJuwara in the year 2023 at Brikama Fula Kunda and diverse place in the Republic of the Gambia, had made a false pretense and with intent to defraud induced one Samuel Gomez to deliver the sum of D975,000.00 with the representation that he legally owned two(2) plots of land situated at the Brikama Fula Kunda measuring 25×40 and 25×50 for sale, which representation the accused knew at the time to be false or not true, thereby committed an offence.
Cadet ASP M. Jarju represented the prosecution, applied to have the matter adjourned, and didn’t make any objection to the bail of the accused person.
The court orders that the determination of the bail of the accused person will be decided on the next adjournment date on the 6th of June 2024.
Section 288 of CPC states that any person who by any false pretense and with intent to defraud, obtains from any other person anything capable of being stolen, or induces any other person to deliver to any person capable of being stolen is guilty of misdemeanor and is liable to imprisonment for three years
