Sheikh Sey, a Senegalese, on Tuesday, 9th July 2024 appeared before Magistrate Fatou Darboe-Jaguraga of the BrikamaMagistrates’ Court for allegedly killing Lamp Faal by stabbing him in his chest.
Prosecutor Officer, Sergeant 4906 Bangura represented the Inspector General of Police in this matter.
According to the indictment, Sheikh Sey is charged with murder contrary to section 187 of the Criminal Procedure Code volume III Laws of the Gambia, 2009.
The particulars of his offence stated that Sheikh Sey did on the 4th day of July 2024 at Gunjur village, Kombo South District, West Coast Region of the Republic of The Gambia committed an offence to wit malice aforethought caused the death of Lamp Faal by stabbing him with a knife on his chest.
Before the accused person takes his plea, Sergeant Bangura said that the court lacks jurisdiction to preside over the matter as the punishment if found guilty attracts life imprisonment. He therefore applied under sections 62 (2) and 208 (a) of the Criminal Procedure Code to transfer the matter to the special criminal division of the High Court and for the court to further remand the accused person pending hearing of the case at the High Court.
The court granted both applications pursuant to sections 62 (2) and 208 (a) of the CPC pending the hearing of the matter at the special criminal division of the High Court.
