Magistrate Remands Accused For Demeanour In Court

Alieu Touray was Tuesday 26th August 2024 ordered to be remanded by Magistrate K.B Sambou of the BrikamaMagistrates’ Court due to his gross misconduct during plea-taking. 

Alieu Touray was charged with another person named Ahmed Dem, who was granted bail by the court. 

Ahmed Dem and Alieu Touray are charged with two counts: “Conspiracy and Stealing,” contrary to sections 368 and 252 of the criminal code, Laws of The Gambia 2009.

The indictment stated that the accused persons had conspired with intent to commit a felony therein to wit stealing. It further alleged that the accused persons stole 220 pieces of iron rods of 10mm valued at D74,800.00 being the property of Abdoulie Dibba. 

The incident happened in Jambanjelly on or about the 18th of August 2024, West Coast Region of The Republic of The Gambia. Both accused persons denied the charge pressed against them. 

Sergeant I. Sowe applied for an adjournment to enable the prosecution to secure its witnesses without objecting to the bail for the accused.

The court granted bail to the first accused person, Ahmed Dem, in the sum of D74,000.00 with one Gambian surety. 

“However, I use my discretion to deny the 2nd accused person bail because of his demeanour in court. He shall be remanded at the Mile 2 Central Prisons until the next adjournment date when this honourable court shall determine whether or not he will be granted bail,” Magistrate K.B Sambou ruled.

Meanwhile, The matter is adjourned to September 24th for continuation.
