Accused pleaded guilty to two counts of offence before Magistrate Touray

Fallou Tunkara charged with malicious injuries and stealing has pleaded guilty to the offence before Magistrate Thomas Tourayof Kanifing Magistrate Court yesterday, Tuesday, 3rd September when he was taking his plea.

The accused was charged with two counts of offence, which include malicious injuries and stealing. According to the statements of his offence, the accused, Fallou Tunkarasometimes

in July 2024 at Senegambia and diverse place in the KanifingMunicipal Council willfully and unlawfully broke the door of Lamin Darboe valued D7,000 and stole the following items – 7 bottles of a smirk of vodka valued at D1,425, 1 carton of pearly bay white valued at D2,850, 1 car battery valued at D1,500, 1 radio speaker valued at D1000 totaling D6,775. 

However, the accused pleaded guilty on both counts of the charge when it was read in a local language he understood. 

Inspector Lamin Badjie in his narration of the incident said it happened in July at Senegambia at Darboe’s Restaurant where the accused unlovely entered the restaurant repeatedly in the morning and stole the following items 900 euros, D66,000,  and D5,750. He explained further that the accused broke the office of Darboe’s Restaurant by going and coming up four times where he stole a carton of red wine valued at D2,850, a carton of white wine valued at D2,850 and some bottle of a smirk of vodka and a one radio speaker with a car battery. 

The broken door is valued at D7,000. After the operation done by the accused the owner of the restaurant, Lamin Darboe who had his CCTV Camera fixed on immediately after the incident asked the accused who confessed that he did it (broke into the restaurant and stole the items). 

Inspector Badjie continued in his narration that the accused was then escorted to the Senegambia Police Station where he was charged while he accepted all the operation was done by him. After his confession, he was asked about the items and money but he replied to the police “I’ve used it all to run my business.” 

At this juncture, He replied to the Magistrate’s question “Yes, I agree with the narration but there are two items that were not stolen by me, the 900 euros and car tape these are the two items I didn’t steal in the restaurant.”

The accused claimed that he was working at the restaurant at a time.      He also made it clear that once he entered the restaurant anything that was stolen was his fault.

Magistrate Thomas Touray said that the accused remains guilty on both counts even before the narration and after the narration. The court shall remand the accused at Mile II Central Prison till the next adjourned date.

The case was adjourned to Tuesday the 17th of September 2024 for judgment.
