The Presiding Vocational Judge Sheriff B. Tabally of Banjul High Court on Thursday, granted a pregnant woman accused, Isha Kamara, a D1 million bail bond for having in her possession the prohibited drug called Kush.
Before granting her bail, Isha Kamara was in State custody for four months while on trial before Magistrate Ismaila Dibba of Bundung Magistrates’ Court.
The accused is currently on trial on two counts of offence which are being in possession of prohibited drugs for trafficking contrary to Section 43 (4) (E) and Section 35 (1) (B) of the Drug Control Act 2003 Laws of The Gambia.
However, Magistrate Dibba was unable to grant Isha a court bail because he lacked the jurisdictional authority to do so.
But when defense counsel M Njain sought for Isha’s bail before Justice Sheriff B.Tabally the State counsel A. A. Wakawa did not oppose it.
”I hereby grant the relief sought. The originating summons dated the 24th September 2024 is hereby varied,” Justice Tabally said.
The Presiding Vocational Judge Tabally said ”The applicant is admitted to bail with the sum of D1,000,000 (one million Dalasis) with three (3) Gambian sureties in the like sum,” he ruled.
Justice Tabally ordered the sureties of Isha to deposit their original national Identity Cards with the Court Registry, stating that Isha’s sureties shall be deposed to an affidavit of means.
Justice Tabally also issued an order for Isha to report to the nearest DLEAG Office at least once every fortnight (2 weeks) until the determination of the trial.
Meanwhile, according to the particulars of her offence, Isha Kamara together with one Mohammed Conteh and Muhammed Kamara sometime on 16th March 2024 between the hours of 2: towards 3:00 am onwards at LatrikundaSabji and diverse places in Kanifing Municipality within the jurisdiction of this honourable court they were found in possession of a gross weight of 2kg ,400mg and a net weight of 2 kg , 400mg of Kush.
