Court Admits into Evidence Invoice of Over D58,000 inGACH’s Civil Suit Against Kaddija Kebbeh & Saihou Drammeh

Justice Ebrima Jaiteh of the Banjul High Court on 13 November 2024, admitted into evidence an original invoice of D58,965,150 in civil suit that GACH Global Trading Limited filed against Khadijatou Kebbeh and Saihou Drammeh.

It could be recalled that GACH Global, through its lawyer Ida D. Drameh, filed a summon dated 22 December 2021, against Khadijatou Kebbeh and Saihou Drammeh, seeking D$221,000.00, being the amount that Khadija and Saihou “fraudulently” acquired and retained as payment for petrol product supplied by Gam-petroleum Storage Facility.

GACH is seeking from the court D 58,961,150.00, being the amount ”fraudulently” acquired and retained by Khadija and Saihou together with $ 1,600.00, allegedly being commissionsaid to have been paid to and received by Khadija for ”ostensibly” facilitating a petroleum product agreement dated 16 September 2021.

GACH is also asking the court for an interest of 24% from 31 August 2021, to the date of judgment with a D1M legal and administrative fees among other claims.

When the civil suit was called on Wednesday, lawyer M.Gomez for GACH Global Trading Company Limited applied to tender into evidence an original invoice of KuringoCompany Limited after it was produced before the court by one Fatoumatta Zahra of Kuringo Company, bearing the name of his client.

Without any objection from defense lawyers KaddijatouJallow and Badou S.Conteh, the court admitted into evidence an invoice dated 18 October 2021, in the sum of D58,965,150 as exhibit p6.

However, when lawyer M. Gomez applied to tender into evidence five duplicate copies of Gam-Petroleum Storage Facility Company Limited’s agreement with GACH dated 2 July 2021, subject to the production of the original documents, the defense lawyers raised an objection, claiming that such application was not in conformity with the Evidence Act. 

The presiding judge Ebrima Jaiteh overruled their objection and then admitted into evidence the agreement ofGam-Petroleum Storage Facility Company Limited andGACH dated 2 July 2021, as exhibit p1.
