One Modou Jallow has been remanded in custody until final determination of the case on charges of stealing, threatening violence, and escape from lawful custody.
By the court presided over by Magistrate A. Fofana of the Brikama magistrates’ court on charges of stealing, threatening violence, and escape from lawful custody.
He appeared on Wednesday, November 20,2024 before Magistrate A. Fofana of the Brikama magistrates’ court and the Inspector General of Police was represented by Inspector Fadera, while the accused was not represented.
On count one, the prosecution changed the accused with “stealing” contrary to section 252 of the Criminal Code cap 10:01 volume 3 laws of The Gambia 2009.
According to the particulars of the offense on count one, Modou Jallow on or about the 18th day of November 2024, at Gunjur village, Kombo Central, stole fiscal cash of D1,000.00 from the shop of one Mrs Kaddijatou Jallow, thereby committing an offence.
On count two, the prosecution charged the accused person with “threatening violence” contrary to section 84 of the Criminal Code cap 10:01 volume 3 laws of The Gambia 2009.
The prosecution alleged on count two that, Modou Jallow on or about the 18th day of November 2024, at Gunjur village, Kombo Central, threatened to kill Kaddijatou Jallow with a knife, thereby committing an offence.
The third count forwarded by the prosecution charged the accused person with “escape from lawful custody” contrary to section 106 of the Criminal Code cap 10:01 volume 3 revised laws of The Gambia 2009.
According to the particulars of the offense on count three, Modou Jallow on or about the 20th day of November 2024, at Brikama police station, while in lawful custody, unlawfully escaped through the back door of the station, thereby committed an offense.
The accused pleaded not guilty to all the counts when read to him.
Prosecutor Inspector Fadera objected to the bail of the accused based on the reasons that the accused was arraigned in the same courtroom on the 12th day of November and on the 18th of November 2024, after his arrest by a mob at Gunjur on a similar offence.
He added that the accused attacked a shopkeeper at Gunjurwhere he nearly stabbed the shopkeeper’s son, took all the money from the shop and absconded, and was later caught nearly beaten to death.
“The accused is a treat to residents of Gunjur. He is a notorious criminal and he has another two ongoing matters which are under investigation. Both are breaking into the shop of one Seedy Muhammad Faal of Gunjur. These are already before this honourable court. The police and court must ensure the citizens and their properties are safe. Based on the above reasons we humbly urged this honourable court to have the accused person remanded pending the final determination of his case,’’ the prosecution sought the court’s indulgence.
The court granted the application made by the prosecution and the accused was remanded pending the final determination of the case. The matter resumes on the 12th of December, 2024 for continuation.
