Police Officer Testifies in Felony Trial

A certain Wally Joof was yesterday arraigned before Magistrates Thomas Touray of the Kanifing Magistrates’ Court on allegations of jumping into a compound to commit felony therein.

Sergeant 4195 A Baldeh announced his appearance for IGP while the accused was not represented by counsel 

Prosecutors charged Wally Joof with attempt to commit a felony contrary to section 368 of the Criminal Code cap 10.01 volume 3, Laws of The Gambia (2009). The prosecution alleged that Wally Joof on or about the 18 August 2024, at Serekunda in the KanifingMunicipality, jumped into a compound of one Alieu Barry with intent to commit a felony. 

Yankuba Kujabi a resident at Sinchu Alagie and a police officer who is posted to the Serekunda police station was called as a witness to give his account of the charge.

He was asked whether he recognizes the accused person and if anything transpired between them. The witness replied affirmative, and he was asked to explain to the court.

He explained that while on duties on that particular day at Serekunda Police Station, one Alieu Barry from Serekunda health centre came with Wally Joof at the Serekunda Police Station and said Wally Joof was apprehended at the health centre around 1:00 hrs in the morning. 

‘’When he was apprehended and brought to the police station, we listen to both parties and their statements were taken. We obtained both voluntary and cautionary statements from the accused person. According to the compound owner, Alieu Barry, the accused went to his compound to steal but the accused denied the allegations and stated that he went to the tap to drink. We also obtained the witness’ statement and later detained the accused person,’’ he informed the court.

Matter was adjourned to Wednesday 11 of December, 2024, at 11.30 for cross-examination of the prosecution witness by the accused person.
