Murder Suspect Remanded At Mile II

Murder suspect Oumie Jallow appeared before Magistrate I.O. Njie at the Brikama Magistrates’ Court on Monday to answer charges of murder.

Oumie Jallow was charged with the alleged offense of causing the death of one Jainaba Jallow on or about 17 December 2024, in Jalambang village by strangling her.

She denied wrongdoing.

ASP Buteh Sawaneh, prosecuting reminded the court that murder is a capital offense punishable by death.

“I am aware of the provisions outlined in Section 5 (1) of the Criminal Procedure Code (CPC), which empowers this court to preside over all offenses with the exception of treason,” stated ASP Sawaneh. 

“Furthermore, I have considered Section 5 (1) (a) of the CPC, which, under Legal Notice No. 3 of 2009, established the Special Criminal Division of the High Court to exclusively address capital offenses as specified in Section 143 (1) of the 1997 Constitution,” he added.

Consequently, ASP Sawaneh requested that the case be transferred to the Special Criminal Division of the High Court pursuant to Section 62 of the CPC, and that the accused be remanded under Section 208 (A) of the CPC, pending further proceedings before the Special Criminal Division. 

The court granted his application and the case will be transferred to the Special Criminal Division of the High Court in accordance with Section 62 of the CPC. 

Meanwhile, Oumie will remain in custody until subsequent arrangements are made in the high court.
