Bubacarr Jawo, Muhammed Jabbie Drammeh, and Essa Jah were yesterday arraigned before Magistrate Thomas Touray of the Kanifing Magistrate Court for conspiracy to commit a felony, and stealing.
The trio was charged for a two-count of offences – count one “Conspiracy to commit a felony contrary to section 368 of the Criminal Code Cap 10.01 Volume III Revised Laws of The Gambia 2009. Count two stealing contrary to section 252 of the Criminal Code Cap 10.01 Volume III Revised Laws of The Gambia 2009.
According to particulars of their offence, on count one read that Bubacarr Jawo, Muhammed Jabbie Drammeh, and Essa Jah did on or about the 20th day of January 2025 at Taban Kololi in the Kanifing Municipal Council, conspired among themselves to commit a felony.
On count two the particulars of their offense state that Bubacarr Jawo, Muhammed Jabbie Drammeh, and Essa Jah on the 20th day of January 2025, at Taban Kololi in the Kanifing Municipal Council in The Republic of The Gambia, stole one mobile phone mark iPhone X valued at D10,000.00 being the property of one Essa Gassama thereby committed an offence.
The first accused Bubacarr Jawo pleaded guilty on both counts while the two other accused pleaded not guilty on both counts.
Magistrate Thomas Touray convicted the first accused as per his plea under the charges, while Inspector Ena Jallow humbly applied for an adjournment to present witnesses.
Magistrate Touray in his ruling said since the first accused pleaded guilty and didn’t waste the court’s time and accepted the allegations preferred against him the court shall remand him for 1-year mandatory imprisonment on count one, while on count two another 1-year mandatory imprisonment and the convict is also ordered to pay compensation to the complainant in the sum of D5,000 for the cost of the Mobile phone. He was also ordered to pay a fine of D3,500 to the complainant in default to serve 1 year of imprisonment.
The judgment for the second and the third accused shall be determined by the court on the next adjourned date, 27th March 2025.
