BubacarrJawo, Muhammed JabbieDrammeh, and Essa Jah yesterday appeared before Magistrate Thomas Touray of the Kanifing Magistrates’ Court in connection with a theft case.
As the case proceed, the prosecution brought forth two charges against the defendants. The first charge was for “Conspiracy to Commit a Felony,” in violation of Section 368 of the Criminal Code, Cap 10.01, Volume III, Revised Laws of The Gambia 2009. The second charge pertained to “Stealing,” contrary to Section 252 of the same code.
The particulars of the first charge indicate that on or about January 20, 2025, at TavanKololi in the Kanifing Municipal Council, BubacarrJawo, Muhammed JabbieDrammeh, and Essa Jah conspired with each other to commit a felony. The second charge specifies that on the same date and location, they allegedly stole an iPhone X valued at D10,000.00, which belonged to EssaGassama.
BubacarrJawo, the first accused, entered a guilty plea for both counts, while Muhammed JabbieDrammeh and Essa Jah pleaded not guilty to the charges.
In light of the guilty plea, Magistrate Thomas Touray approved a conviction for BubacarrJawo. Chief Inspector EnaJallow respectfully requested an adjournment to allow for the presentation of witnesses during the next hearing.
The magistrate ruled that, as a result of his guilty plea, BubacarrJawo will serve a mandatory one-year imprisonment for count one, followed by another year for count two. Additionally, he was ordered to provide compensation to the complainant for the cost of the stolen mobile phone and to pay a fine of D3,500. Should he be unable to pay the fine, he will serve an additional year in imprisonment.
The court will determine the outcomes for the second and third accused parties at the next scheduled hearing.
This matter has been adjourned to March 27, 2025, for further proceedings.
